Ending the 100-Mile Constitution-Free Zone
Federal law lets immigration officers search you without a warrant within a "reasonable distance" of the border. The government defined that distance as 100 miles back in 1953. Not Congress. A regulation.
That 100-mile band now covers two-thirds of the country, including nearly all of Michigan's Great Lakes shoreline. You don't have to live near Mexico or Canada to lose your Fourth Amendment rights. You just have to live in Michigan.
As Senator, Lydia will introduce legislation repealing the inland "reasonable distance" extension in 8 U.S.C. § 1357. Border inspection stays at the border, where it belongs; at an actual port of entry or crossing point. It does not follow you 100 miles inland.
Away from the actual crossing point, probable cause and a warrant apply, the same as they do for every other law enforcement agency in America.
Policies on this page are living documents. Lydia updates them as research, legislation, and community input evolve. If something here should be sharper, more accurate, or missing entirely, tell her campaign.
